Hon'ble
passed
the
judgement
as
,
"The
burden
of
proving
guilt
is
on
prosecution
and
beyond
reasonable
doubt
any
doubt
must
be
given
in
favour
of
accused.
In
this
case,
various
shortcomings
of
not
recording
evidences
omissions
and
contradictions
of
injured
ones
which
go
to
the
root
of
matter...
Definitely
doubt
arises
of
investment
of
accused
on
basis
of
these
evidences
appellant
can't
be
convicted.
Though
in
the
mind
of
common
man
it
may
be
different
perception.
There
are
so
many
hypothesis
possible.
Investigation
was
in
a
faulty
manner
specially
the
procedure."

Judge
further
continued,
"Lastly,
the
appreciation
was
not
properly
written
and
for
example
it
can
be
said
without
giving
details,
trial
court
has
erred
in
accepting
bills
which
were
recovered
without
any
panchnama.
And
bills
were
fabricated...
This
is
not
the
case,
in
which
the
prosecution
has
successfully
established
its
case
on
charges
an
resultantly
the
following
orders
to
be
passed."
