have
lodged
a
complaint
against
a
couple
engaged
in
real
estate
development.
The
complaint
alleges
that
Pronit
Nath
and
Amisha
Nath
deceived
them
of
Rs
1.3
crore.
Karishma
Tanna

Kochhar,
in
his
complaint,
claimed
that
the
individuals
pretended
to
sell
apartments
and
deceived
him
of
₹58.50
lakhs.
It
also
stated
that
his
friend
Varun
Baangera
was
cheated
of
₹44.66
lakhs.
The
case
was
filed
on
October
21,
2023,
at
Andheri
police
station
in
Mumbai
and
involves
charges
under
sections
409
(criminal
breach
of
trust),
420
(cheating
and
dishonesty),
and
120
(B)
(criminal
conspiracy)
of
the
Indian
Penal
Code.
According
to
the
FIR,
Samir
Kochhar,
a
businessman
in
JVPD,
Andheri
West,
and
his
wife
and
friend
Varun
Bangera
were
searching
for
properties
in
December
2020
when
they
met
a
couple,
Pronit
Nath
and
Amisha
Nath.
They
then
presented
the
Kochhar
couple
and
Bangera
with
their
plan
of
constructing
a
four-floor
building
in
Pali
Village.
They
then
decided
to
buy
a
flat
on
their
property
on
the
assurance
that
the
land
was
free
of
loans.
The
payment
was
made
with
cheques
however,
later
it
was
discovered
that
the
property
had
a
loan
against
it
and
that
Nath
had
mortgaged
the
land
with
a
financial
company.
Despite
their
regular
follow-ups
on
the
construction
status,
Nath
reassured
them
on
June
3,
2022,
that
the
building
would
be
finished
within
three
months.
However,
matters
took
an
unexpected
turn
on
June
23,
2023,
when
Nath
conveyed
through
WhatsApp
messages
that
they
were
not
to
sell
the
property
and
would
keep
it
for
themselves.
This
came
as
a
surprise
to
the
Kochhar
couple
and
Bangera.
The
FIR
was
lodged
after
Ntah's
message,
where
he
mentioned
that
he
had
already
entered
into
a
Memorandum
of
Understanding
(MOU)
to
sell
the
property
to
another
party.
In
an
attempt
to
enforce
the
MOU,
Kochhar
approached
the
High
Court,
seeking
directions
for
Nath
to
proceed
with
the
agreement.
On
July
26,
Justice
Kamal
Khata
issued
a
restraining
order,
preventing
Nath
from
selling
the
flat
to
a
third
party.
Nath's
contested
the
decision
before
a
division
bench
of
the
High
Court,
but
on
October
5,
the
bench
led
by
Chief
Justice
DK
Upadhyaya
declined
to
overturn
the
single
judge's
order,
prohibiting
Nath
from
transferring
ownership
of
the
disputed
flat.
