SRK's Late Employee Gets Justice: Nearly eight years after a tragic accident that led to the death of Charu Khandal, a talented animator at Red Chillies Entertainment, justice has been served. The Bombay High Court confirmed that Khandal's family will receive a compensation of Rs 62.2 lakh. This decision upheld the initial award from the Motor Accidents Claim Tribunal, which was contested by the insurance company. The court found this amount to be "fair and reasonable," acknowledging the extensive suffering Khandal endured and the significant financial strain her medical treatment placed on her family.
Charu Khandal, an animator for Shah Rukh Khan's production company, faced life-changing injuries from a hit-and-run accident in 2012. This incident left her paralyzed until her passing in 2017. After the Motor Accidents Claim Tribunal granted compensation to her family in November 2020, Cholamandalam MS General Insurance Company appealed against this decision. However, on May 9, 2024, Justices Girish Kulkarni and Advait Sethna dismissed this appeal, reiterating the compensation's fairness given the dire nature of Khandal's circumstances.
Remembering Charu Khandal's Legacy
Khandal was not just an employee at Red Chillies Entertainment; she was a part of the team that brought the 2011 Bollywood film Ra.One to life, earning a National Award for their efforts. The celebration of this achievement turned tragic on March 24, 2012, when the auto-rickshaw carrying her, along with her sister Ritu and friend Vikrant Goyal, was hit by a speeding car. While Ritu escaped with minor injuries, Khandal and Goyal were critically injured, leading to Khandal's paralysis from the neck down.
Despite the insurance company's arguments that Khandal's death wasn't a direct result of the accident and pointed to supposed deficiencies in her medical documentation, the court ruled otherwise. The judges found that her quadriplegia, caused by the accident, led to her death. They emphasized the principle of compensation under the Motor Vehicles Act, meant to support victims and their families rather than being restricted by strict technicalities.
Support in the Face of Tragedy
Throughout her ordeal, Charu Khandal received considerable support from various quarters, including Shah Rukh Khan. The Bollywood superstar visited her at Kokilaben Dhirubhai Ambani Hospital, engaging with both her medical team and her family, offering words of encouragement and hope. Khandal's relationship with Sagar Thacker, a fellow animator, also highlighted the personal toll of her condition. Thacker expressed regret over not being with her on the night of the accident, a decision that haunted him as Khandal strived to reclaim some normalcy in her life.
Despite her severe condition, Khandal sought to adapt, using assistive technology to regain her ability to speak and interact with computers. Prof. Prabhat Ranjan played a key role in her rehabilitation efforts, showcasing her resilience and determination to overcome the challenges posed by her injuries.
The court's ruling, describing Khandal's story as a "heart-wrenching and tragic saga," underscores the irreplaceable loss of life and the necessity of fair compensation in such cases. The judges stated, "Perfect compensation is hardly possible, but fair compensation ought to be the norm. Each case has to be decided on its own facts." This ruling not only provides financial relief to Khandal's family but also honors her memory and contributions to the Indian film industry.
