A single-judge bench headed by S Vishwahjith Shetty heard the plea of the actor and assessed the bail application submitted by Darshan. The bail was granted to the actor to let him undergo a surgery. Another bail plea by Darshan, seeking regular bail is pending for hearing at the high court in which he challenged the trial court's order.
On the other hand, Justice Shetty has delivered his judgement after the extensive arguments by senior advocates S Nagesh and State Public Prosecutor, P Prasanna Kumar. Darshan has filed the bail application on September 21.
Earlier, a medical report was submitted by the doctors from the Bellary Central Prison and head of the department of Neurology, Bellary Government Hospital. Later, the court assessed the reports that suggested Darshan to undergo a surgery in his spine and feet.
Darshan, after experiencing numbness in both feet, also requested permission for his surgery to be performed at a private hospital for which he will bear all the cost. However, it was questioned the state public prosecutor on why it cannot be performed at a government hospital and why the actor hasn't mentioned the number of days the surgery will require. But Darshan's lawyer Nagesh pointed out that state doesn't have the authority to dictate where an undertrial person shall recieve treatment.
