Justice Hema Commission Report: Court Stays Release Of Report On Women’s Conditions In Malayalam Film Industry

High Court Stays Release of Justice Hema Committee Report

Kerala High Court Stays Release of Justice Hema Committee Report: On Wednesday, the Kerala High Court issued a stay on the release of the Justice K. Hema Committee Report, which addresses women's working conditions in the Malayalam film industry. The report, originally scheduled for dissemination at 4 PM today to petitioners of the State Information Commission, will now be withheld for one week, according to a report by Bar and Bench.

The decision came in response to a petition filed by Malayalam film producer Sajimon Parayil, who argued that making the report public could have detrimental effects on the film industry. Parayil's plea contends that the report's release could compromise individual privacy, breach confidentiality, and potentially harm the reputations and livelihoods of industry professionals, including those who contributed their viewpoints and testimonials.

Petitioner Criticizes Limited Redactions In Hema Committee Report Disclosure

The Kerala government set up the Hema Committee in 2017 to investigate the challenges faced by women in the film industry, following a petition from the 'Women in Cinema Collective'. The Committee submitted its findings to the government in 2019, but the state refrained from disclosing the report despite repeated requests under the Right to Information Act.

On July 5 this year, the State Information Commission (SIC) mandated the report's disclosure, subject to the redaction of certain sections. Parayil's petition before the High Court criticised the limited redactions ordered by the SIC, arguing that the decision was against public interest and infringed on the privacy rights of individuals, including himself.

The petition further claimed that disclosing the report could expose individuals to potential retaliation and harassment, thereby breaching the confidentiality promised to those who provided testimonies.

During today's hearing, the State Information Commission's Standing Counsel and the Government Pleader questioned Parayil's standing to file the petition, suggesting that his interests were primarily private.

Representing Parayil were advocates Saiby Jose Kidangoor, Benny Antony Parel, PM Mohammed Salih, Nazrin Banu, Ameer Salim, and Irene Mathew. Advocate M. Ajay appeared on behalf of the State Information Commission.
